Valley Metro Bus Strike Lawsuit

Here are the nity gritty details about the bus strike and about the lawsuit I plan on filling against Valley Metro and the cities of Phoenix, Tempe, Mesa, Chandler, Scottsdale and Gilbert.

Here is the bus pass I purchased, but which I could not use on August 1 thru 4 in the cities of Chandler, Tempe, Mesa and Gilbert which had all of their bus service stopped by the bus strike.

Some of the bus service was stopped in Phoenix and Scottsdale too. But other bus unions also provide bus service in Phoenix and Scottsdale so bus service did not come to a complete halt in Phoenix and Scottsdale like it did in the other cities.

Also the light rail service, which is run by another union continued to provide service. I did ride once on the light rail during the strike, when I went to the First Fridays event in downtown Phoenix.

Here are photos of both sides of my bus pass, which I could not use during Aug 1 thru 4. The bus pass number seems to be # L31-0013125. I probably bought it at the APS office in Chandler.

H*ll freezes over??? - Temporary tax doesn't become permanent???

It is very rare that a temporary tax doesn't become a permanent tax.

According to this article a temporary sales tax in Arizona just expired without becoming a permanent tax.

I was kind of surprised today when I went to Circle K to buy my daily 44 ounce dose of caffeine and sugar and I was only charged 85 cents instead of the usually 86 cents.

If I remember correctly while the temporary tax that just expired was billed to education, health and public safety (law enforcement, cops, police, LEOs) that almost all of the tax went to the police and just a fraction of it went to education and health.

It's getting warm!!!!

Today it is supposed to hit 107°F. Not to hot by Arizona standards but it is getting up there.

Currently I am wearing two sweat shirts when I go to sleep at night.

Next week I will probably reduced that to one sweatshirt.

I don't really need the clothing to keep warm, it's mostly to keep bugs from attacking me, and to keep me from getting cut when I walk thru mesquite forests.

Mesquite and Palo Verde trees have some nasty thorns on them.

Last to be honest while I love hot weather this heat has kind of snuck up on me.

Usually it slowly climbs from under 100° to the 110°+ temps, but it seems to have just jumped from the 90°'s to 107°.

My feet are out of shape and actually got hot after walking a few 100 yards or meters on the hot asphalt yesterday.

It's supposed to be 109°F today, and well by Arizona standards that is actually hot.

Mesa, Arizona to hit hospitals with a $461.91 patient tax???

According to this article Mesa Mayor Scott Smith and the other royal rulers on the Mesa City Council are planning on shaking down hospitals for a $461.91 tax for each patient???

They say the tax will help Mesa hospitals provide cheaper medical services to their customers.

Even if you are a big time smoker of crack or medical marijuana that sounds like a fantastic whopper being told to us by the royal rulers of the city of Mesa!!!!

A $461.91 patient tax on each hospital patient will reduce medical cost????

I bet Mesa Mayor Scott Smith has been taking seriously that BS Obama gives us how Obamacare will provide us with cheaper medical care.

Big bird on the road???

As I was walking back from the desert this morning I saw a huge bird standing on the road.

The bird was probably chest high on me. It must have been at least 3 and a half to 4 feet tall.

I made a detour thru the desert to avoid it because I was afraid it might attack me.

I was surprised the bird didn't fly off when it saw me.

On the other hand maybe the bird was sleeping and didn't see me, which I find odd.

I suspect the bird was an egret, which I have seen before.

Why we have egrets in the stinking desert is beyond me.

Horne uses Jodi Arias verdict to keep his plea bargain out of the news????

Elected officials are usually masters of using the media to get their stories to the public.

If they want to get one of their press releases well covered they will put it out an a slow news day so the media doesn't have much else to cover and will give their press release more attention.

On the other hand when they don't want the public to know something they will usually do it on a day when the media has lots of other important stories to cover, hoping their negative news won't get much coverage.

And of course that is what the media is accusing Arizona Attorney General Tom Horne of doing in this case where he copped a plea to his hit and run case.

Tom Horne is one of the government tyrants that have been trying to flush Arizona's medical marijuana laws down the toilet. Arizona Attorney General Tom Horne along with Arizona Governor Jan Brewer are the folks who filed frivolous lawsuits in Federal court attempting to flush Prop 203 down the toilet.

A lot of times when I walk thru the desert I just point my body at a landmark and start walking in that direction on autopilot and just go off daydreaming.

I was doing that yesterday when I was walking thru the desert and I was woken up out of my daydreaming when it sounded like a mean nasty animal was about to attack me.

Well it wasn't a mean nasty animal but a small bird.

I was walking straight at the bird. The bird seem very angry and ran toward me. I thought it might attack me.

I don't know what the bird was up to, but I suspect that one of the birds buddies had an accident and was hurt laying on the desert floor.

Ain't much sense in voting. Only the politicians win!!!!

A simple DUI ticket will cost you $10,000

My understanding was the the standard fine for a simple DUI or DWI ticket used to be $1,000 and it was recently doubled to $2,000.

I was talking to a woman who was somehow involved with the ASU college of law and she said that a simple DUI ticket will cost your $10,000 when you throw in all the costs, before an attorney.

She said in addition to the fine they will charge you to install a breathalyze interlock on your car to prevent you from driving when you have drank.

She said they even charge you a couple of hundred dollars every couple of months to re-calibrate the breathalyze interlock.

She said they will also shake you down for money to attend the silly driver safety classes.

She said that an attorney she knows started up a business installing and maintaining the breathalyze interlock devices on cars because it is so profitable.

She said he makes a lot more from the breathalyze interlock business then he does with his law degree.

You expect a fair trial? Don't make me laugh!!!

Fraud probe vs. Phoenix officer may hurt DUI cases

Prosecutors are supposed to share ALL the information they have with the defense so that people have the information they need to defend themselves.

Of course prosecutors routinely hid information because they are more interested in carving another notch in their gun by getting a conviction then giving a person a "fair trail".

In the 300+ cases where DNA testing has freed people framed by the police from death row, many of the people were convicted because the prosecutors hid information from the defense lawyers that would have proved the accused person didn't commit the crime.

In this case Phoenix prosecutors and I think Maricopa County prosecutors are accused of hiding information that Phoenix Police Officer Jerry Schuiteboer is accused of committing a number of felonies and may be a crooked cop who can't be trusted to tell the truth on the witness stand or in his police reports.

This also gets into how money corrupts the criminals justice system.

If the city of Phoenix loses the 40 DUI case that Phoenix Police Officer Jerry Schuiteboer has arrested people for they stand to lose a minimun of $800,000 in fines and possibley a lot more depending on how many of the cases were extreme DUI arrests.

Currently DUI fines start at $2,000 and go up from there.

Many civil rights activists and freedom fighters consider the DUI laws to be all about raising revenue for city and county governments and have almost nothing to do with safety.

An owl above me???

As I was walking thru a mesquite forest I accidentally looked up and was surprised to see an owl sitting on a tree branch above me.

The owl was only 8 to 10 feet above me.

It was a huge bird maybe 1 and a half to two feet tall.

I was kind of surprised because the owl didn't fly off after he saw me.

The owl did seem surprised that I was looking at him and he just moved his head and stared at me as I walked by.

Warm weather???

I will never complain about hot weather and in fact I will take a 120°F day any day of the year over a freezing cold 60°F day.

Yesterday it was above 110°F. I think it may have hit 112°F and I was surprised to be rather warm when I went to bed.

I walked a couple of miles back to the city and soaked my sweatshirt in water to cool down and then walked back out to the desert to go to sleep.

So if a cop violates your rights, it will make it much harder for the cop to lie and say he wasn't at the location he violated your rights at. Of course even if the cop gets caught in a bold faced lie, don't expect him to get punished with any more then a slap on the wrist.

In order for a Republican and Democratic to win an election they MUST get more then half of the Independent voters to vote for them.

And many of those Independents who would normally vote Republican tend to vote Libertarian, which means the Democrats end up winning close elections.

Cold wave in Phoenix?????

Two nights ago I was freezing when I went to bed. Because of a few 115°F+ days I was soaking my sweatshirt in water before I went to sleep.

But it backfired on me and I almost froze to death because it didn't get a degree hotter then 105°F.

Last night I didn't soak my sweatshirt in water, but it was still chilly when I got up in the morning.

I was wonder if i would be the first person in history to die of hypothermia (that's freezing to death, for those of you that are English challenged) in a cold Arizona summer. Well cold for me.

The newspaper says it should be 110°F by Wed and maybe 115°F by Friday.

Now that's much better weather if you ask this desert rat.

Another stinking owl on a fence

A couple days ago as I was walking around in the desert I walked by an owl sitting on a fence.

The owl was so close to me I went out of my way to walk around the owl so I wouldn't be attacked by it.

As I was walking around it the owl flew off.

Also I have seen a couple more of those huge white birds flying in the sky.

My initial guess is they are egrets.

Oddly the Arizona Republic had an article on birds and said that despite it being a stinking desert that egrets do come here.

Another cold summer night

2 sent to prison for creation, sale of machine guns

According to this article Randolph Benjamin Rodman and Idan C. Greenberg both licensed gun dealers, have been imprisoned for machine-gun manufacturing and sales.

Many legal experts say any and all of these laws making machine guns illegal are unconstitutional per the 10th Amendment.

In fact one of the first cases on which involved a sawed off shotgun (which is subjected to the same laws a machine guns) was United States v. Miller ruled that the National Firearms Act of 1934 (NFA) was unconstitutional at in the lower court.

Oddly nobody showed up to represent Miller in the Supreme Court and the Supreme Court reversed the decision because only the Federal government was represented in the case and the National Firearms Act of 1934 (NFA) was constitutional.

"Neither the defendants nor their legal counsel appeared at the Supreme Court. A lack of financial support and procedural irregularities prevented counsel from traveling. Miller was found shot to death in April, before the decision was rendered."

Texas carries out its 500th execution since 1982

According to this article the blood thirsty tyrants in the state of Texas have murdered 500 people since 1982.

Texas has murdered at least one innocent person on death row. That was Cameron Todd Willingham who was executed in 2004.

Texas cops and prosecutors used what is now know as junk science to convict Cameron Todd Willingham of murdering his three young children by arson.

I suspect that many other people have been framed by the police and executed by the government for crimes they didn't commit in Texas and other states.

In Arizona there are at least two cases where people were framed by the police and convicted of murders which involved arson and used the same junk science as the Texas conviction.

Temperatures in the Valley will likely reach 119 degrees today, 117 on Saturday and 116 on Sunday. All three would set records for those days.

The National Weather Service issued an excessive-heat warning from this morning through Sunday morning, said Keith Kincaid, a meteorologist with the service’s Phoenix branch.

Even the low temperatures over the weekend will actually still be high, he said. The overnight lows Saturday and Sunday are expected to top 90 degrees.

Much of the country is forecast to have above-average temperatures this weekend. Almost all of Texas and Arizona and much of New Mexico will top 100 degrees; temperatures will be in the 90s throughout much of the rest of the Midwestern and Western states.

Forecasters say Salt Lake City and Las Vegas could set heat records. Meteorologists are predicting 127 today, 128 Saturday and 129 on Sunday in Death Valley, Calif.

But while Phoenix residents suffer and sweat, they should bear in mind that it could be worse — 119 degrees is still a few degrees lower than the city’s record 122-degree high set on June 26, 1990.

Even the high lows seem merciful compared with the 96-degree highest low-temperature record, set Aug. 15, 2003.

From April to October, Phoenix typically has more than 100 days with temperatures above 100 degrees, according to the National Weather Service. June, July and August all have average highs above 104.

The forecast for today also is 15 degrees lower than the all-time world-record high of 134 degrees set in Death Valley on July 10, 1913. (For many years, an apparent reading of 136 degrees in Libya on Sept. 13, 1922, had been considered the all-time high, but that reading was invalidated. In 2012, the World Meteorological Organization certified Death Valley’s 134 as the official all-time high.

Even that is still 24 degrees lower than the 158 degrees the sidewalk would have to be to actually fry an egg, or so the Library of Congress says.)

Kincaid, the meteorologist, said that, for him, it doesn’t make much difference whether it’s 109 degrees or 115 — he finds summer heat generally unpleasant.

“I don’t like it,” he said.

He prefers the weather in fall and winter and feels sorry for his co-workers who have to fix meteorological equipment outdoors.

He said he also feels pity for construction workers and people repairing air-conditioners and pretty much anyone else with an outdoor gig.

Kincaid advises that any outdoor tasks be completed in the early morning and that people who plan to be out and about don wide-brimmed hats.

Improbable as it might seem, the heat reminds the Phoenix transplant Anders Berg of his home in Sweden, where temperatures aren’t likely to be much above 65 degrees this weekend.

“It’s like if it’s a snowstorm in Sweden,” he said. “You stay inside, you don’t go out.” The heat, like the bitter cold, isn’t something to acclimate to, he said, but rather something to avoid. [Yea remember a guy from freezing cold Sweden is saying that. I LOVE this HOT weather!!!!!]

Berg, who owns SwedeClean, a Valley carpet-cleaning company, said that he once nearly passed out from the heat while working in a house without air-conditioning. But, even so, he doesn’t miss the Scandinavian cold of home.

“I’m miserable when it’s cold, I’m miserable when it’s hot,” he said. “I’m a human being, never satisfied.”

Berg used to live in Saudi Arabia, and he said that when temperatures there climbed past a certain point, around 110 degrees, the government would order people to stay home from work.

He said it could be a good idea here, too. “If I’m president of United States and it’s 105 degrees or more, I’d say, ‘It’s a holiday!’ ” [Wow! It would be a holiday a third of the year in Phoenix]

What brought the Swede to the desert, anyway?

“I always say loooovvvvvve,” Berg said, explaining that he followed his wife here when she moved from Cleveland to be closer to her parents.

And he does find upsides to living in Phoenix, he said — there aren’t any earthquakes or tornadoes, and few mosquitoes. And there’s never a need to bundle up.

“Kids in Sweden, you have to put 500 jackets on them,” he said. “Then, you get them out there, and they say, ‘Daddy, I have to go pee.’ ”

A wimpy 116°F today

Sounds like the Arizona Republic really hyped the heat. It only hit a lousy 116°F today, instead of the near record 118°F or 119°F the Arizona Republic was predicting.

The all time record for Phoenix is 122°F which is about 50°C.

Find out the people who passed created this bill and then check out the companies that gave them money.

SB1087 or SB 1087 is pretty much just a government welfare program for companies that make their money giving drug tests.

According to an article in the Arizona Republic the 13,000 or so taxi cab drivers in Arizona will be required to get random annual drug tests, which these companies that give drug tests will charge them about $100 for, bringing in about $1.3 million in revenue.

While the taxi cab drivers are required by law to take the drug tests, and the companies that employ them are required to have a copy of the drug tests on file the tests are totally meaningless and even if the employees flunk the test, the companies that hire them are not prevented from hiring them.

Bottom line is the test are not needed, nobody cares about the results, the people of Arizona won't benefit one way or another from the tests, and the only people that will stand to benefit from the tests, are the companies who will charge each taxi cab drive about $100 every year to take the silly unneeded test.

I suspect the companies that give drug tests bribed, oops, I mean gave campaign contributions to the elected officials who passed this stupid law which is nothing more then a government welfare program for corporations that give drug tests.

An owner of a livery vehicle, taxi or limousine licensed through the department shall have available for inspection at all times by the department written evidence of a criminal background check and drug testing records of any driver operating a livery vehicle, taxi or limousine for the owner, whether as an employee or lessee. The criminal background check and drug testing shall be completed before the driver is engaged as an employee or lessee. Drug testing records shall include preemployment drug testing results and random annual drug testing results for the driver, whether as an employee or lessee.

At this web site they will use the GPS metatags embedded in you photos to tell you the location that your photo was shot at.

Most modern cell phones will allow you to record the location of any photos you shoot by embedding meta tags which contain the GPS location the photo was shot in the photo's files.

Will some people, like those phony baloney libertarians, David, Ernie and Mike will accuse me of giving this information to the cops, I am sure the cops already have this information and know how to extract the GPS information from you photos.

A few months back software billionaire John McAfee made the news on this issue when he was a fugitive and was releasing photos to the media.
